Deputies Named In Mulino Shooting

The Clackamas County sheriff's office revealed the identities Saturday of two deputies involved in a fatal shooting at a Mulino home last week.

Deputy Brian Lister shot and killed Burt Henkel on Wednesday night after showing up at a home on Macksburg Road to serve a search warrant, according to the sheriff's office.

For months, deputies had been investigating Henkel and his companion Marjorie Crawford, who are accused of manufacturing marijuana. At 10:30 p.m., deputies Lister and Jesse Ashby made their way to the Mulino home to serve the search warrant.

Newly released documents reveal Lister opened fire on Henkel after he came to the door armed with a gun. Authorities said Henkel pointed his gun "in a threatening fashion directly at each of the two deputies."

The sheriff's office said the two deputies followed procedure -- they tried to disarm Henkel, but felt threatened and, ultimately, shot and killed him.

The shooting is Lister's second officer-involved shooting in as many years. In February 2008, Lister shot and killed a suicidal man who came at him with a gun. A grand jury cleared him of any wrongdoing.

Lister and Ashby remain on paid administrative leave for their roles in last week's shooting.

The sheriff's office released the following information on the two deputies:
  • Deputy Brian Lister - who has prior law-enforcement experience with the Molalla Police Department dating back to December, 1998; the Seaside Police Department, between May, 2003 and January, 2007. Brian Lister was hired as a Clackamas County Sheriff's Deputy in January, 2007.
  • Deputy Jesse Ashby – has prior law-enforcement experience while serving with the West Linn Police Department as a reserve Officer between October, 2001 and July, 2003. Moving into a full-time West Linn Police Officer position in July, 2003, until January, 2007. Deputy Ashby was hired as a Clackamas County Sheriff's Deputy in January, 2007.
