Accused Wendy's Rapist Has Prior Arrests

PORTLAND, Ore. -- The man accused of raping a co-worker at a Wendy's fast-food restaurant has been arrested at least twice before and may be in the country illegally, according to court records.Evanivaldo Alejo-Sebastian was arrested twice before -- once in 2006 and once in 2007 – in the Kansas City area.Deputies in Missouri haven't said why he was arrested either time.In 2006, deputies released Alejo-Sebastian on his own recognizance, and in 2007, he posted bail and deputies released him two days after his arrest.However, there were more discrepancies in Alejo-Sebastian's past.Both times he was booked into a Kansas City jail, his birth date was listed as 1980. But after his arrest Sunday in Milwaukie, his birth date was written as 1979.Deputies said sometime Monday afternoon, Alejo-Sebastian, went into the Wendy's bathroom while the victim was inside and raped her.The alleged victim's mother said she is outraged at the situation and can't believe how brazen her daughter's attacker was."(I feel) anger, just anger that he thinks he had the right to do something like that, and apparently he thought he was going to get away with it. If he didn't, he would have bothered to leave the scene of the incident," the woman said.The alleged victim's mother said she didn't know it until Monday, but there had been previous attempts to hurt her daughter."Apparently in the last couple weeks some things had happened that had led up to this," she said.Monday night, the victim's mother said she thinks Alejo-Sebastian is in the U.S. illegally.U.S. Immigration officials haven't confirmed Alejo-Sebastian's status, but Clackamas County deputies confirmed that an INS hold has been placed on him as they look into whether he is in the country legally or not.ICE agents said Tuesday he is a Mexican national and he could face deportation after the rape investigation in Clackamas County is over.Alejo-Sebastian made his first court appearance Tuesday, using a translator to hear the charges against him.The alleged victim's mother said she can't believe this happened while her daughter was trying to show she could be self-sufficient."She's being independent you know, she's making her own money and liked working there. She liked the people until now," she said. "I hope that justice is served."
