PORTLAND, Ore. -- A 9-year-old Portland boy said he witnessed two students at his elementary school having sex in a bathroom stall.Portland police officers and school administrators said they're investigating whether a crime was committed during the possible incident on May 15 at Beach Elementary School in north Portland.Cherie Broadway, the boy's mother, said her son told her about the incident when he came home from school."He came in and told me that he went to the restroom during his recess and there was a boy humping a girl in a bathroom stall," Broadway said.The boy said he walked inside the bathroom and heard crying."Then I went inside the stall and saw what was happening," the boy said. "Then I said, 'I'm going to tell the duty,' and he pulled his pants up and he threatened me."The boy said he immediately returned to recess and told the on-duty adult."I told the duty and she said, 'No, you're lying to me. That doesn't happen here,'" the boy said.Broadway said her son wasn't able to identify the girl, but she said he was able to point out the boy in an elementary school yearbook."The little girl was crying when my son walked in. Her pants were completely off, the little boy's pants were pulled down and (the girl) was turned around backwards," Broadway said.School district officials said the boy named by Broadway's son was in class at the time of the report. They said there is a record of it because students at the K-8 school must sign out of class.Detective Mary Wheat, a spokeswoman for the Portland Police Bureau, said there was no crime committed if the children were having consensual sex. Portland Public Schools officials said they're taking the report seriously and trying to determine if there's a victim in the case.At this point, police said there's not enough evidence to determine whether a crime was committed, but the boy's parents said their son would not have made up the story."He still likes being a little kid, climbing trees and stuff," said Rock Broadway. "And that's what they should be doing -- not thinking about having sex in a bathroom at school."The Broadways said they're telling their story in case there is a victim who has yet to speak up."I'm hoping the victim will come forward so she can get the help that she needs," Cherie Broadway said. "And I want the perpetrator taken out of my children's school. My kids will not go back to that school until something is done."
