Battle In Horman Custody Case Continues 10-25-2010

Kyron Horman’s father said he’s been told by police that judges have determined probable cause exists to implicate his estranged wife in the boy’s disappearance, according to court documents released Monday.
The records are part of an on-going custody battle between Kaine and Terri Horman for their young daughter. Kaine Horman filed for divorce about three weeks after Kyron vanished from his northwest Portland grade school after a June 4 science fair.
In the documents, Kaine Horman said he doesn’t want Terri Horman to have any contact with 23-month-old Kiara, even if it’s supervised.

“It causes great pain to wonder if Kiara was with (Terri Horman) on June 4, 2010, and witnessed some unimaginable act of horror,” the documents state."I believe that any contact that (Terri Horman) has with our daughter will be detrimental and will jeopardize her physical safety and emotional well-being."
Lawyers for Terri Horman filed a motion Oct. 15 requesting parenting time. She is barred from seeing the child by a restraining order filed by Kaine Horman in June.
Kaine Horman offered a retort shortly after, saying he believes Terri Horman "abducted and may have caused unimaginable harm" to Kyron.
Terri Horman's lawyer previously argued that Kiara's health and well being are at stake if she doesn't get time with her mother.
A hearing for the motions is scheduled for 1:30 p.m. Nov. 4. A Jan. 6 hearing is also set in the divorce case.
Kaine Horman said he filed a restraining order against Terri Horman after he was told by police that his wife tried to hire someone to kill him and that she was involved in Kyron’s disappearance.
“Law enforcement officials have informed me that more than one circuit court judge has determined probable cause exists to implicate (Terri Horman) in Kyron’s disappearance and in the murder-for-hire plot,” according to the documents.
In addition to restating his belief that Terri Horman “harmed or secreted” the missing boy, the documents also contain allegations involving his estranged wife and alcoholism.
"I believe that (Terri Horman) is severally emotionally disturbed and unfit to parent Kiara," the document states. "Her actions are horrifying and unexplainable."
The court records also included several pages of text messages between Terri Horman and Michael Cook, a high school classmate of Kaine Horman. Some of the messages appear to show that Terri Horman knew investigators were monitoring her.
"Flashing your phone means they can listen in on my phone conversations and see who I talk to,” she texted.
Kaine Horman said the texts were "deeply concerning" and that his daughter is doing much better without her mother.
“(Kiara’s) emotional well-being, personality and sleep patterns have greatly improved since Kiara and I separated from (Terri Horman),” the documents state.
In the days following his son’s disappearance, Kaine Horman said he tried to get his wife to open up about what happened but she refused. She also failed two polygraph tests and walked out of another, he said in the documents.
Investigators said Terri Horman was the last person to see Kyron.
She has been the focus of law enforcement fliers and questionnaires, but deputies haven’t named anyone as a suspect or person of interest in the criminal investigation.
