FOX 12'S THE X FACTOR AUDITION PASS CONTEST

 

OFFICIAL RULES

 

NO PURCHASE NECESSARY TO ENTER OR WIN. 

 

FOX 12's THE X FACTOR AUDITION PASS CONTEST (the "Contest") begins at 5:00 a.m., Pacific Time ("P.T."), on March 12, 2012, and ends at 11:59 p.m., P.T., on March 18, 2012 ("Promotion Period"). Entries must be received by 11:59 p.m., P.T., on March 18, 2012.

 

SPONSOR:  KPTV/Meredith Corporation, 14975 NW Greenbrier Parkway, Beaverton, Oregon (hereinafter referred to as "Sponsor"). 

 

AUDITION ENTRY: Visit kptv.com and submit a completed online entry form.

 

Then follow the directions to upload an a cappella video audition no longer than two (2) minutes in length. Each entry must be submitted privately for only Sponsor and judges to review.

 

Note: 

 

A parent/legal guardian is required to complete the entry process and video upload for their child/ward 12-17 years of age.

 

Only one member of a group should be designated to complete the entry process and video upload.

 

There are four (4) categories: Female Singers ages 12-29, Male Singers ages 12-29, Older Singers ages 30 and above (no upper age limit) and Vocal Groups, made up of at least 2 singers (no upper age limit).

Sponsor makes no guarantee that all audition videos received will be reviewed.

Audition video content requirements:

1.     Audition Videos must conform to the requirements of these Official Rules and  YouTube terms of use. Any terms and conditions may be amended at any time.

2.     Your performance must be a cappella (no instruments or backing track).

3.     Audition Videos should not exceed two (2) minutes in length, and should include a brief introduction (approximately 30 seconds) which includes the name of the Act (if a group) and the names and ages of Act members. Sponsor reserves the right to allow for minor differences between entrant's timing device and the actual run-time of the Audition Video, so long as in Sponsor's discretion there was a clear intent to comply with these requirements.

4.     Audition Videos must have been recorded within the past two (2) months and should not be digitally enhanced or distorted.

5.     Audition Videos must be shot in a non-descript location or with a plain backdrop.

6.     Audition Videos must NOT include people who are not members of your Act.

7.     Audition Videos must NOT contain material which is sexually explicit, obscene, pornographic, violent (for example, relating to murder, weapons, cruelty, abuse, etc.), discriminatory (based on race, sex, religion, national origin, physical disability, sexual orientation or age), illegal (for example, underage drinking, substance abuse, computer hacking, etc.), offensive, threatening, profane or harassing.

8.     Audition Videos must NOT include, mention or feature any uncleared copyrighted material, including but not limited to music, films, books, television programming, artwork, sculpture, photographs, etc., or identifying descriptions of any copyrighted material.

9.     Audition Videos must NOT include any third party trademarks, logos, insignia, location signage, etc.

 

By submitting an Audition Video, entrant and any member of a group, hereby grants to Sponsor, in perpetuity, a non-exclusive, royalty-free, sublicenseable and freely transferable license to use, reproduce, distribute, prepare derivative works of, display, adapt, reformat, translate, and otherwise exploit and perform all or any portion of the Audition Video for any purpose whatsoever, throughout the universe.

LIMIT:  One video submission entry per person or group.  Participation in only one video submission is allowed.  

ELIGIBILITY: Legal residents of Oregon and Washington, who are 12 years of age or older as of January 1, 2012 (and have parental permission), are eligible to enter, except employees of Sponsor, Blue Orbit Productions, Inc., Fox Broadcasting Company, Fox Digital Media, Inc., FremantleMedia North America, Inc., Simco Ltd. d/b/a Syco TV, Sony Music Entertainment, Telescope, Inc., and any other organizations affiliated with the sponsorship, fulfillment, administration, prize support, advertisement or promotion and/or their respective agents, affiliates, subsidiaries, and members of their immediate families or persons residing at the same address.

 

Contestants must be eligible to audition under the published The X Factor Season 2 audition rules which can be found at www.fox.com/thexfactor.   

 

JUDGING:  A qualified panel of judges selected by Sponsor will judge all eligible video auditions.  Entries will be judged based on: Vocal Ability (1-10 points), Stage Presence (1-10 points) and Appearance (1-10 points).  In the event of a tie, a Category winner or Finalist will be the entry with the higher/highest score in the Judges Overall Ranking. Up to 12 Finalists (3 per Category) will be selected and from those Finalists, one (1) grand prize winner will be selected.  Sponsor reserves the right not to select any Category Finalists if, in its sole discretion, it does not receive a sufficient number of eligible and qualified contestants in any Category. All decisions of judges and Sponsor regarding winner selection and this contest are final.  Decisions of judges are final and binding in all respects. 

 

WINNER SELECTION:  The Finalists will be announced during MORE Good Day Oregon between 9:00-10:00 a.m., P.T., on March 22, 2012. The four (4) Category winners (one (1) winner per Category) and grand prize winner will be announced during The 10 O'clock News between 10:00-11:00 p.m., P.T., on March 22, 2012.

 

Each Category winner must be able to appear and sing at The X Factor Season 2 San Francisco audition on April 20, 2012.   

 

The four (4) Category winners are guaranteed one (1) audition in front of an X Factor producer at The X Factor Season 2 San Francisco audition on April 20, 2012, at Cow Palace. Audition passes are non-transferable and cannot be sold to or used by any person(s) other than the Category winner and designated guest.   Any Category winner who is a minor must be accompanied by parent/legal guardian to the San Francisco audition.

 

At the San Francisco audition, Category winners will be judged on the criteria listed in the official The X Factor rules and will not receive preferential treatment for callbacks. Decisions for callbacks are made solely by the judges. Winners will not audition in front of any X Factor Judge or any X Factor Guest Judge during the guaranteed audition.  Category winners will not be entitled to skip the cull process.

 

Sponsor and FOX reserve the right to cancel the Contest in whole or in part, to change start and end dates of Contest to the extent necessary to adjust to events of force majeure, production and broadcast schedules, without financial or legal liability of any nature whatsoever.  In the event production of The X Factor is cancelled or postponed, the prizing may be cancelled without substitution or compensation. 

 

PRIZING:  One (1) Grand Prize winner will receive a prize package consisting of a San Francisco audition pass (no retail value is assigned to the pass), roundtrip transportation (air, Amtrak or vehicle) to San Francisco to perform at The X Factor Season 2 audition on April 20, 2012, and hotel accommodations, selected by Sponsor, for up to three (3) nights (April 19-21, 2012), approximate retail value of the prize package is up to $2,000.00. Number of travel companions will be determined by Sponsor based on whether the grand prize winner is a minor, group or individual.  Any difference in the actual prize value and the approximate retail value will not be awarded.  Winner is responsible for all other expenses not listed including but not limited to ground transportation, hotel parking, meals, beverages, tips, telephone charges, incidentals and all other personal expenses. No retail value is assigned to the audition pass prize component. 

 

The three (3) Category winners will receive a San Francisco audition pass and are responsible for paying for all expenses to/from San Francisco for the audition. No monetary value is assigned to the audition pass prize component. 

 

Sponsor is not responsible for any circumstances that make it impossible to fulfill the prizing. No prize substitution. Sponsor will determine all elements of prizing in its sole discretion. Prizes may not be assigned, transferred, changed or redeemed for cash.  Prizes are awarded "as is" with no warranty or guarantee express or implied by Sponsor. Sponsor disclaims all and any liability for the actual provision, quality or nature of any third party product or service accepted by the winners. The awarding of any prize is contingent upon full compliance with these Official Rules.  Entrants agree to be bound by these Official Rules and the official The X Factor rules and agree that if any winner fails to provide proof of identity, refuses to provide required documentation, is found to have violated the Official Rules or otherwise does not meet eligibility criteria, prize will be forfeited and may be awarded to an alternate winner with the next highest score. Entrants understand that Sponsor is not liable for injuries, losses or damages of any kind arising from participation in this promotion and acceptance, possession and use of prize. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the contest or in the announcement of the prize. Decisions of Sponsor are final and binding in all respects. 

 

OTHER:  Sponsor assumes no responsibility for entries it is unable to process due to network, hardware or other technical failures; or any other reason, or incomplete, damaged, misdirected, or lost entries.  Sponsor reserves the right, in its sole discretion to disqualify any person in violation of these Official Rules, tampering with the audition process, or for any reason or for no reason at all, or remove suspect Audition Videos. Sponsor further reserves the right, in its sole discretion, to cancel, terminate or modify this promotion if not capable of completion as planned.  In the event of cancellation or termination, Sponsor reserves the right to judge audition videos and select Finalists/Category winners from among all eligible entries received prior to date or time of cancellation or termination.  Any conduct that violates or tampers with the audition video process, is unsportsmanlike or disruptive or impedes the integrity of the contest is prohibited. 

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR WILL DISQUALIFY ANY SUCH INDIVIDUAL AND RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS' FEES) AND OTHER REMEDIES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

 

Entrant and any member of an Act represents and warrants as follows:  (i)  the Act is the copyright owner of the Audition Video; (ii) the Audition Video is the Act's own original, previously unpublished, and previously unproduced work; (iii) the Audition Video is wholly original with the Act and as of the date of submission is not the subject of any actual or threatened litigation or claim; (iv) the Audition Video neither infringes upon nor violates the intellectual property rights or other rights of any other person or entity; (v) the Audition Video does not and will not violate any applicable laws, and meets the audition video submission requirements. Audition Videos must not contain any unauthorized third party owned material, including, but not limited to, trademarks, logos, music, copyrighted photos, etc.

The online audition is subject to all applicable federal, state, and local laws.  Each entrant and Act member hereby:  (a) agree that Sponsor shall have no liability whatsoever for, and shall be held harmless by entrant and/or Act member against any liability for any injuries, losses or damages of any kind to person(s) (including death) or property resulting in whole or in part, directly or indirectly, as a result of participating in this online audition or any related activity; (b) releases Sponsor and its respective advertising and promotion partners, fulfillment and/or judging agencies, retailers, francises, agents and their estate and/or family members from all liability, claims, action, or proceedings relating to this online audition and from injuries or damages arising in connection with or relating to participation in this online audition; and (c) waives any right to claim ambiguity in the online audition or these Official Rules.

PRIVACY:  Information collected from entrants is subject to Sponsor's online privacy policy at kptv.com. 

RELEASES:  Entrants authorize the Sponsor to use their name, voice, likeness, biographical data, city and state of residence, contest audition video/tape(s), and any other entry materials in promotional material and for advertising, public relations and editorial purposes worldwide, in perpetuity, or on a winner's list, if applicable, without further compensation unless prohibited by law.  Sponsor is not obligated to use any of the above-mentioned information or materials, but may do so and may edit such information or materials, at Sponsor's sole discretion, without further obligation or compensation. 

If a potential winner cannot be contacted or is unable to audition in San Francisco, the potential winner is disqualified and the prize is forfeited.  If forfeited, an alternate winner may be determined.   Category winners (parent/guardian if a minor) must complete and return an Affidavit of Eligibility/Liability, Publicity Release and W-9 by March 28, 2012, or trip and audition will be forfeited. 

 

By participating in the online video audition and/or winning an audition in San Francisco, Category winners release Sponsor, Fox Broadcasting Company, News Corporation, Fox Digital Media, FremantleMedia North America, Inc., Blue Orbit Productions, Inc., Syco, Simco Limited, their parents, affiliates, subsidiaries and agents, licensees and assignees and their respective officers, directors, employees, and agents from any and all liability with respect to the prize won and participation in the contest. Subject to all U.S. federal, OR or WA state and local laws and regulations.  Void where prohibited.  Applicable taxes are the sole responsibility of the winners.  Grand prize winner will be issued an IRS 1099-MISC tax form.  For the winners' list, send a self-addressed, stamped envelope after April 12, 2012, to Winners' List/ FOX 12's The X Factor Audition Pass Contest at the Sponsor's address above.
