PORTLAND, OR (KPTV) -
A Portland man is going to prison for more than three years after pleading guilty to beating a 15-year-old boy on a Max platform near the Rose Quarter.
"I just wanted to apologize to the family," Quincy Wynn, 26, said at his sentencing hearing Monday. "I didn't know he was 15 and I'm sorry."
On Jan. 11, Josiah Kuehl was walking to the Max platform near the Rose Garden after leaving a wrestling tournament at Benson High School. After the attack, he told Fox 12 he had the green light to cross Interstate Avenue.
Kuehl said the driver of a car, who police identified as Wynn, apparently got angry we he crossed in front of him, and called him over to the car.
Kuehl, who was wearing earphones, approached the car and was punched in the face.
Surveillance video released to the public for the first time Monday, shows the driver hitting Kuehl multiple times. The teen stumbles onto the rails. The driver then kicks him and leaves.
The teen suffered a concussion, a bloody noise and bruising. Five months later, his parents said he is still suffering physically and mentally.
"Sometimes you can just hear him screaming in his sleep. Tells me he can't get it out of his head," said his father, Robert Kuehl. "He's having a hard time wanting to forgive anybody. He thinks everybody's out to kill him. That's the only impression he's got in his head right now."
Robert and Shannon Kuehl said their son, who was not in court, still has serious headaches, wakes up in cold sweats and has ringing in his head, a side effect from the trauma.
While Josiah Kuehl still wakes up two to three times a week, it's a marked improvement from the first weeks after the attack, they said.
"He takes one day at a time," Shannon Kuehl said. "And he tries not to think about it."
Police were able to use the surveillance video to track down Wynn. He was arrested on three counts of second-degree assault and a charge of tampering with evidence in March.
As part of a plea deal, Wynn pleaded guilty to third-degree assault in June and the other charges were dropped. He will serve three years and four months in prison, then have two years of post-prison supervision.
Robert Kuehl said he is satisfied with the sentence, but is heartbroken the attack happened in the first place. He told the judge there were two victims.
"The guy [Wynn] just lost a lot of his life. He could go to college, have a job, get married. A lot of things he could do that he has to give up because of what he did," he said. "Another kid has to give up part of his life to get help and treatment for things he's going through that he didn't plan on. And in that case, two different families got very badly injured."
