PORTLAND, OR (KPTV) -
The deadly police shooting of a man in North Portland last month has been ruled as justified by a grand jury.
Billy Simms was shot and killed by Officer Justin Clary after a road rage investigation on July 28.
Police first responded to reports in the area of Southeast 122nd and Division that afternoon.
Police said Simms shot at another car while he was driving in the area.
Officers then came across Simms at a 7-11 in north Portland.
They said he got in the car, started it and drove out of the lot. That's when the officer fired his gun.
The car crossed North Fessenden Street and crashed into an unoccupied unit in an apartment building.
Simms was killed.
He was also a suspect in an armed robbery at a marijuana grow house the week prior. His family said he had recently graduated from rehab.
The Multnomah County grand jury returned a not true bill in the case Friday, meaning it was justified under criminal law.
