Lawsuit filed over Portland-Milwaukie Light Rail Project

A Clackamas business owner is filing a lawsuit to try and put a stop to bond sales for Trimet's Portland-Milwaukie Light Rail Project.

Thelma Haggenmiller filed the lawsuit Friday against the Clackamas County Board of Commissioners.

She wants the $19 million bond sale to fund construction to stop.

The lawsuit charges that the board failed to give voters official notice and an opportunity to petition a revenue bond sale before the bonds are officially offered to the public.

Haggenmiller's attorney Kristian Roggendorf said state law requires counties to give voters the chance to gather signatures to put local revenue bonds up for a county-wide vote.

Roggendorf said the county describes these bonds as "obligations," but believes they fall within the statutory definition of "revenue bonds."

The bond sale is scheduled to start Sept. 6.

The Portland-Milwaukie Light Rail Transit Project is set to connect downtown Portland, inner southeast Portland, Milwaukie and north Clackamas County.

Construction began on the project's bridge over the Willamette River in July 2011.

The completed Portland-Milwaukie project is scheduled to open in September 2015, according to TriMet.
