Convicted killer to receive a new prison sentence

PORTLAND, OR (KPTV) -

A convicted killer could be released from prison sooner than expected.

A judge ruled that Todd Davilla will be resentenced on Nov. 26. He was convicted of murdering Lisa Flormoe in 1991 after trying to rape her and received a life sentence in 1992.

That initial ruling has been disputed several times because Davilla was charged as an adult, even though he was 16 when the crime happened.

The last time he was resentenced he was given 57 years behind bars.

On Thursday, a judge ruled the state did meet its burden of proof for the "aggravating factor" of use of a deadly weapon. However, the judge ruled the state did not prove the aggravating factor of deliberate cruelty for the crime.

The victim's family has continued fighting to keep Davilla in prison and expressed extreme disappointment in the judge's latest ruling.
