Convicted killer receives new prison sentence

PORTLAND, OR (KPTV) -

A convicted killer will spend 30 more years behind bars.

Todd Davilla was resentenced Tuesday to 50 years in prison, minus the 20 he has already served. He received a life sentence in 1992, but that ruling has been disputed several times because Davilla was charged as an adult, even though he was 16 when the crime happened.

He was convicted of murdering Lisa Flormoe in 1991 after trying to rape her.

Last month, a judge ruled the state met its burden of proof for the "aggravating factor" of use of a deadly weapon in the crime. However, the judge ruled the state did not prove the aggravating factor of deliberate cruelty for the murder.

The victim's family has fought to keep Davilla in prison and expressed disappointment last month when the judge ruled to give him a new sentence.
