A report by the state liquor department claims the restaurant and bar where an Arizona State University student was last seen alive broke state liquor laws when it served the 19-year-old man.
Investigators said Cadillac Ranch cannot prove it checked Jack Culolias' identification, because it wasn't recorded in an ID log. Under the eyes of the law, not doing that means it wasn't checked.
Culolias drowned in the Salt River in November. His body was found several days later.
Culolias was at a fraternity party at Cadillac Ranch at Tempe Marketplace on Nov. 30. Documents show he was escorted out of the bar for urinating off a balcony.
His identical twin brother, Alex Culolias, said it's been a rough few months.
"It's hard, you know? I lost half of my being with him gone," Alex Culolias said.
"Our investigation found that Mr. Culolias did purchase alcohol at Cadillac Ranch with his credit card," Liquor Department Sgt. Wes Kuhl said.
A timeline of video surveillance shows Jack Culolias ordering a beer around 9:50 p.m. and paying the bartender. At 10:02 p.m., Jack Culolias went back to the bar and ordered another drink. A witness said he had wide and red eyes and that he was wobbly.
"I don't have any ill feelings toward anyone. It was ultimately my brother's choice that he went there or not, but I do feel they should have denied entry to him," said Alex Culolias.
Investigators said Jack Culolias' body was found with a yellow wristband, the color designated for legal drinking age at the bar, but that there was no proof Jack Culolias' fake ID was ever checked.
The department of liquor is filing administrative charges against the establishment for not checking IDs and for providing alcohol to underage people, Kuhl said.
Alex Culolias said he wants his brother to be remembered for more than just that night.
"He was an awesome person. He had a beautiful smile and had a lively personality," he said.
A representative for Cadillac Ranch said a new camera over the front door will be installed, as well as a policy to scan IDs with an iPod to electronically record every ID.
Kuhl said they have reached out to the restaurant to work something out. A fine, liquor license suspension and revocation are all options, he said.
