No criminal charges for driver in crash that killed 11-year-old girl

ALOHA, OR (KPTV) -

No criminal charges will be filed against the man who was behind the wheel in a collision that killed an 11-year-old girl.

Kylie Hornych was hit and killed in the front yard of her Aloha home in April. Deputies said Wednesday the driver suffered from a diabetic episode, and prosecutors declined to press charges.

Witnesses said the driver, David Herman, was traveling at a high rate of speed when he drove his Toyota Prius into a 2010 Jeep Wranger head-on on the north side of Farmington Road. The car continued south on Southwest 160th Avenue and dropped car parts along the way, according to investigators.

Witnesses said the car swerved several times, crossed over a sidewalk, crashed through a barricade, hit a tree and several mailboxes before hitting the little girl. The car finally stopped after crashing into her house.

Kylie was a fifth-grader at Chehalem Elementary School.
