Man convicted of rape 1 year after acquittal in separate rape case

A 23-year-old Vancouver man is guilty of rape one year after he was acquitted of the same charge in a separate case.

A jury convicted Cody Dornbirer of third-degree rape Friday. They did not reach a verdict on two other charges of second-degree rape and indecent liberties.

According to court documents, Dornbirer was arrested in May 2011 after the victim said she was out with friends and acquaintances, including Dornbirer.

When they returned to her home early in the morning, he asked if he could stay the night at her house. The victim agreed, according to court records.

Police said while she was talking to a friend on the phone, Dornbirer took the phone, spoke to the friend and then told the victim she could not have the phone back.

He took it upstairs with him, went onto the victim's bed and pushed her down when she tried to retrieve her phone, court records state.

Dornbirer then pinned her down on the bed and raped her, police said.

The woman got away, left her home and returned at 7 a.m. to find Dornbirer still there. She told him to leave, which he did at 8 a.m. Vancouver police then arrested him.

His sentencing is scheduled for Aug. 23.

A Coos County jury acquitted Dornbirer of charges including rape, sex abuse and kidnapping in June 2012.
