A 91-year-old man accused of driving through the scene of a deadly highway shooting and leading police on a high-speed chase is out of jail, but he's been told not to drive.

Troopers said they first spotted Marseill Gunnyon driving in a closed section of Interstate 84 near The Dalles at around 5:30 p.m. Thursday.

Four hours earlier the highway was shut down for a police-involved shooting that left one man dead and a trooper wounded.

Police said John Allen II, 34, of Portland, shot a trooper during a traffic stop on Interstate 84 near The Dalles. Trooper Matthew Zistel returned fire, hitting Allen, who then attempted to drive away and was found dead in his car a short time later.

Police said Gunnyon was contacted by troopers and told to turn back to Briggs Junction. They followed his 2001 Chevrolet Blazer westbound in the eastbound lanes, but said he didn't exit at that location. Instead, he continued westbound, police said, passing temporary barriers into an extensive traffic backup.

Troopers say at one point Gunnyon was driving 80 mph, and they had to use spike strips to stop him. Except, police said, he tried to keep going.

The spike strips shredded three of his tires and he finally stopped off Exit 87 and in the front parking lot of the OSP The Dalles Area Command Office.

Gunnyon was booked in jail and is facing charges in two counties, because he crossed the line between Wasco and Sherman counties. He is charged with attempt to elude, hit and run and reckless driving.

He was released from jail Friday and is due back in court Oct. 4 in Sherman County and Oct. 7 in Wasco County. He has been ordered not to drive any motor vehicles until that time and he is only allowed to travel between Oregon, Washington and Idaho.

Police said there was no evidence of intoxication and Gunnyon had a valid driver's license.
