GERVAIS, OR (KPTV) -

An Amtrak train hit and killed a Gervais High School student Tuesday night.

It happened around 7 p.m. near Fourth Street just north of Ivy Avenue in Gervais.

Marion County deputies say two boys, aged 13 and 14, were walking from Woodburn to Gervais using the train tracks to shorten their trip.

Deputies said the area has two sets of tracks and is not designated or designed for people to walk on.

Deputies said they think the boys saw the Amtrak train coming from the north but did not clear the track they were on because they thought the train was on the other set of tracks.

The train hit Diego Rodriguez, of Gervais, killing him instantly, deputies said.

Rodriguez was a Gervais Alternative High School Student and according to family a "'good kid,'" deputies said.

Deputies said they notified the school and that the high school was making preparations to console any grieving students.

In their press release Tuesday, Marion County deputies did not mention what happened to the 14-year-old that was with Rodriguez.
