Albany woman dies in hospital, boyfriend now facing murder charge

A man fighting with his girlfriend pinned her down and put his hand and forearm over her mouth until she stopped breathing, according to court documents filed in Linn County.

Devin Hansen, 30, was initially arrested on charges of strangulation, assault and attempted murder Saturday after his girlfriend was rushed to the hospital.

Police said Christine Smith, 29, died at the hospital Monday night.

Hansen is now facing the charge of murder. He pleaded not guilty in court Thursday.

Police were called to an apartment on Southeast Geary Circle in Albany at 6:30 a.m. Saturday. Hansen called 911 to report he was performing CPR on a woman after a domestic dispute, court documents state.

Officers at the scene said Smith's eyes were open, but she appeared to be unconscious.

Hansen had scratches on his face that were bleeding, police said. He told officers that he had just gotten home from work after an eight-hour shift and needed to rest before another 12-hour shift, according to a probable cause affidavit.

Hansen said he asked Smith to sleep on the couch so he could rest. Court documents state he told officers that she responded by saying, "You are gonna do what I want you to do and we are going to hang out today," before throwing things at him and scratching his face.

Police records show Hansen then admitted to holding her down on a couch. Court documents state he placed his hand and forearm over her mouth to keep her from moving, while using his other arm to prevent her from scratching him.

"Devin told me he realized while he was holding her down that she was not breathing anymore," the officer on scene reported, according to court documents.

Hansen said he attempted to perform CPR and called 911.

Smith's 3-year-old daughter was in the room while this situation unfolded, a probable cause affidavit states.

Hansen's next court hearing is set for Feb. 25 at 10:30 a.m.

He's being held in the Linn County Jail without bail.
