Murder charges for man accused of causing 2-year-old boy's death

A man already in jail is now charged with murder for an attack on his girlfriend's 2-year-old son that led to the boy's death.

A Multnomah County Grand Jury issued an indictment Thursday for Joshua Howard on charges of murder, murder by abuse and criminal mistreatment.

Howard, 28, was arrested March 4 after police responded to the Unicorn Motel, 3040 S.E. 82nd Ave., on the report of an unconscious young child.

Court documents state that Howard originally told police that the boy was alone in the bathroom when he heard a thump. Then, he said he "tossed or dropped" the victim in the bathroom, after becoming upset about the boy throwing up in the bed and crying.

Finally, according to a probable cause affidavit, Howard admitted dragging the boy into the bathroom and throwing him with force into the toilet.

The child was rushed to the hospital with a long list of traumatic injuries, including a skull fracture, brain swelling and bruising all over his body. Doctors said he had a pulse when he arrived at the hospital, but no apparent brain activity.

Police said the boy died less than two days later.

Court documents state the suspect told police after injuring the boy, he put him in the bathtub in cold water to try to revive him.

"Defendant also stated that he deserved to be charged with murder and to receive the harshest punishment for what he had done to the victim," court documents state.

A probable cause affidavit states police contacted the boy's mother, who said Howard often hit the child, but she didn't intervene because she felt that would only make him more violent toward the boy.

Howard was originally charged with attempted aggravated murder and assault, but the case was presented to the grand jury after the boy's death.

Howard is scheduled to be arraigned on the indictment in court Friday morning.

A memorial fund has been set up to cover funeral and burial expenses for the boy. His father's family said they will be receiving the remains and will announce a memorial service soon.
