3 families sue Silverton Hospital for malpractice

Three families are filing three separate multi-million dollar lawsuits against a Marion County hospital.

One of the families behind the lawsuit claims their child was born with permanent brain damage and cerebral palsy because of mistakes that happened in the delivery room at Silverton Hospital.

According to court documents filed by the Ramseyer family, doctors at the hospital failed to recognize and respond in a timely manner to Elizabeth Ramseyer's labor process.

The lawsuit states that doctors failed to determine, in a timely manner, that Ramseyer needed a C-Section and then delayed the incision for an unreasonable time period.

Portland medical malpractice attorney Laura Kalur is representing the family and says once baby Maverick was born he was lifeless.

The suit alleges that the doctors at the hospital took too long to bring the baby back to life and there wasn't enough staff to provide the care Maverick needed.

According to the family's attorney, Maverick was deprived of oxygen for about 14 minutes.

"Parents should never be afraid to ask questions of their medical provider, such as, 'What are the reasons I might need to go in for a C-section?' Or, 'If something does go wrong and my baby is having trouble, what qualified medical staff will be available at birth to care for my child?'" said Kalur.

The family says Maverick suffered a catastrophic brain injury resulting in a lifetime of care and expenses, so the family is suing the hospital for $40 million.

According to the Ramseyer's attorney, two other families had similar experiences.

Each of those families is suing for about $40 million as well.

"Failures in communication among medical staff in the delivery room is a leading cause of injuries to newborns," said Kalur.

Silverton Hospital said it can't comment on any pending litigations.

The Ramseyer case is expected to go trial early next year.
