Toledo bar adds to menu after liquor license is revoked

TOLEDO, OH (Toledo News Now) -

Chuck's on Monroe can no longer serve alcohol after the state made a ruling stemming from a wrong way fatal accident in December 2012 where the driver spent some of his night at the bar.

The bar is usually open in the evening but they've been closing at 3:00 p.m. since Thursday May 8 after they lost their liquor license. The bar isn't going anywhere. The owner says he is just going to change things up.

The bar lost its license after being accused of over serving Adam Tunison on Christmas Eve. Tunison got in his car after leaving the bar, drove the wrong way on I-75 and killed Juan Garcia Junior. The state said Tunison had 17 drinks while at Chuck's but bar owner Walter "Bimmer" Smarszcz says he had just 4 mixed drinks, 4 shots and didn't appear to be physically drunk in surveillance video from inside the bar.

Smarszcz said he was shocked by the ruling from the state to take away his liquor license. He has owned Chuck's for seven years and doesn't plan on closing. Instead, he says he wants to make a positive out of a negative and re-open Friday May 16 as a diner that serves breakfast, lunch and early dinner.

"Even through this negative situation, it's kind of exciting because we're doing something new and then down the road if we get it worked out we're going to have a whole avenue, adding breakfast to what we already do before. You can't make everybody happy. Someone is always upset about something. So I'm doing what I have to do for myself and my staff," said Smarszcz.

Smarszcz said it could be about a year before they can get a new liquor license but that is something he is interested in getting again.
