PORTLAND, OR (KPTV) -

The father of Kyron Horman has been granted legal custody of the 5-year-old daughter he shares with ex-wife Terri Horman.

Kaine and Terri Horman finalized their divorce on Dec. 31, 2013. The resolution of custody involving their daughter, however, dragged on.

In court documents filed Wednesday, on the fourth anniversary of Kyron's disappearance, a judge granted Kaine Horman legal and physical custody of Kiara.

According to the court documents, Terri Horman will have the opportunity to re-connect with her daughter as part of a process including individual counseling for both of them. Initial contact will be solely through the exchange of cards and letters and eventually video conferencing which can then progress to supervised visits, the judge's order states.

Terri Horman will maintain the right to inspect and receive school records, as well as medical, dental and psychological records for her daughter.

Following the divorce, Terri Horman initially sought temporary custody of Kiara. Her lawyers filed court documents citing a deposition of Kaine Horman where he stated Terri Horman cared for their daughter between 50 to 75 percent of the time, "at minimum."

Kaine Horman's lawyers said visitation from Terri Horman would only traumatize their daughter.

Court documents state that part of Kiara's counseling will "address Kyron's status."

Kyron Horman was 7-year-old when he seemingly vanished from Skyline School on June 4, 2010. Kaine Horman has maintained his ex-wife was involved in Kyron's disappearance.

This week, Kyron's biological mother Desire Young told Fox 12 that Terri Horman failed three lengthy polygraph tests when questioned by investigators about Kyron's disappearance.

As part of Wednesday's custody decision, court documents state Kaine and Terri Horman are not to knowingly be within 150 feet of each other, unless granted by the court. Terri Horman is also not allowed within 150 feet of Kaine Horman's home, work, gym or Skyline School.
