Oregon Court of Appeals rules pot smoke is not legally offensive

If you smell marijuana coming from a neighbor, it's not legally offensive like garbage or other bad smells.

That's the decision the Oregon Court of Appeals made on Wednesday.

This decision comes from a 2012 case where officers searched a Philomath man's home because of the smell of pot that came from the home.

The new ruling came from a three-judge panel of appeals court who said 'while some odors are objectively unpleasant, rotten eggs or raw sewage come to mind, the others are more subjective in nature.'

With this court ruling, recreational pot users will feel more at ease knowing that smoking pot at home shouldn't bring any problems with police.
