Panel of employers discuss how to handle positive drug tests now that pot is legal

Marijuana is legal for adults to use in Oregon, but if you test positive at work you can lose your job.

Since Oregon's marijuana law changed, workers may use marijuana legally at home and then fail a drug test at work days later.

A group of employers met for a panel discussion on how to handle positive drug tests.

The panel heard discussion points from a Portland Police officer and an attorney.

Companies using some form of drug testing is not new, but what is new is that people are now using a legal drug that can linger in the body for days.

"But right now, the way drug testing is set up, you're either positive for marijuana use or not, and you don't have a good way of determining if the employee is impaired," said Corky Collier with Columbia Corridor.

Organizers of the panel acknowledge that in some professions a zero-tolerance policy is necessary for safety.

In others, it may be worth it for the employer to test for impairment.

Organizers also discussed the possibility of using more subjective testing to reveal if a worker is impaired.
