TROUTDALE, OR (KPTV) -

The owner of the gun that was used to shoot a Reynolds High School student filed a motion asking for his property back.

Lucas Padgett, brother of Jared Padgett, is requesting his gun and other materials be returned to him after being stored in evidence.

Reynolds High School recently recognized the one-year anniversary of the shooting that happened on June 10, 2014.

According to Troutdale police, the shooting happened around 8 a.m. when Jared Padgett walked into the locker room and killed 14-year-old freshman Emilio Hoffman.

Padgett then shot and killed himself.

Police said Padgett used an AR-15 rifle and a pistol that he took from his father and brother to carry out the attack.

In the motion, the Lucas Padgett's attorney claims that the rifle and other materials are no longer needed as evidence, Padgett is entitled to have his property returned to him.

Those other items include Magpul Magazines, several rounds of ammunition, and a U.S. Army issued ‘laundry bag’.
