Oregon regulators say Uber drivers are employees

Posted: Updated:
PORTLAND, OR (AP) -

Oregon regulators say Uber drivers are employees, not independent contractors, under state law.

The guidance issued Wednesday by the Bureau of Labor and Industries is advisory only and has no legal force. Regulators could only sanction Uber if a driver filed a formal complaint and investigators reviewed evidence specific to that person.

Uber has long maintained that it doesn't employ its drivers, but rather serves as a technology platform that connects them with people seeking rides.

Companies face higher costs for employees than they do for independent contractors, including benefits and payroll taxes.

Uber says in a statement that the agency's opinion is based on lax research and inaccurate information.

Labor commissioner Brad Avakian, who issued the ruling, is running for secretary of state and faces a tough Democratic primary.
