Affidavit: Man exposing himself in costume store tackled by employee

PORTLAND, OR (KPTV) -

A man masturbating inside a Halloween costume store in southeast Portland was tackled by an employee and held down until police arrived, according to court documents.

Police responded to the Spirit Halloween superstore on the 10500 block of Southeast Stark Street on Tuesday on reports of a fight.

Officers arrived to find three men holding down another man on the sidewalk in front of the store.

A probable cause affidavit states the officer arresting the suspect, identified as 36-year-old Nigel Smith, reported seeing a "very noticeable wet spot on the front of (the suspect's) gray sweat shorts" that Smith claimed was sweat.

A witness told investigators that Smith was in the store with his genitals exposed and was masturbating while looking at photos of women on the packaging of Halloween costumes, according to the affidavit.

A store employee approached Smith, court documents state, and he pushed the employee and attempted to run away.

According to court documents, the employee was able to tackle Smith, but Smith bit the worker, breaking his skin.

Smith was arrested on charges of felony public indecency and fourth-degree assault.

He has been released from jail and is due back in court Nov. 10.
