Kelso woman suing Chipotle after recent E. coli outbreak

Posted: Updated:

A woman in Kelso filed a $75,000 lawsuit against Chipotle after she says she was infected with E. coli after eating a burrito from a Vancouver location.

Court documents said Charmaine Mode visited the restaurant on October 21. Several days later doctors confirmed she had E. coli after she came in complaining of severe nausea and diarrhea.

Mode has missed several days of work and requests compensation for lost wages and medical expenses through the suit.

According to the complaint filed in U.S. District Court, Washington and Oregon Departments of Health noticed an increase in numbers of E coli cases within their states. They eventually linked the source back to the Chipotle food chain

Health officials in Oregon and Washington have confirmed 22 cases of E. coli in the two states, most of which are in people who recently ate at Chipotle. Officials expect the number of cases to rise.

Chipotle has closed 43 of its restaurants in the two states due to the recent outbreak.

This is not the first time Chipotle has been involved in a foodborne illness outbreak. Court documents said the restaurant also suffered both a Salmonella and a Norovirus outbreak earlier this year.

The lawsuit claims Chipotle was negligent in regard to food safety practices and is liable for Mode's illness. The suit seeks damages of more than $75,000 in addition to court costs.
