Property owner sues city of Portland over ordinance that protects renters

A Portland property owner is suing the city over a new ordinance that protects renters.

The ordinance, which was passed by the city council in October, requires 90 days notice for evictions and rent increases of more than five percent.

Portland Attorney John DiLorenzo, who represents Melcliff Associates,contends the city council over-reached in its new ordinance, enacting what amounts to rent control, which violates existing state statutes.

“Rent control is an issue that the state has taken on as its own, and local governments just aren’t allowed to legislate in that area,” said DiLorenzo. “What the city council has attempted to do is to push the envelope on rent control, which is under the guise of notice provisions, but it’s still rent control, plain and simple.”

DiLorenzo and his client are asking a judge to declare the part of the ordinance pertaining to rent increases invalid. His office expects to file a summary judgment motion in 20 days.
