Affidavit: Suicidal woman sexually abused at Portland crisis treatment center

PORTLAND, OR (KPTV) -

A man staying at a mental health treatment center is accused of repeatedly raping a woman who had checked herself in as a patient due to suicidal thoughts.  

Court documents state the woman checked herself into the Critical Assessment and Treatment Center in northeast Portland on Nov. 30.

The woman told police the suspect, Biniam Yemane Tesfamariam, 30, had stared at her during dinner and again when he passed by her room.

A probable cause affidavit states Tesfamariam, who was at the center due to mental illness, knocked on her door after she went to bed and asked to borrow her phone, and while the woman agreed, she said she was scared and believed Tesfamariam made up an excuse to see if anyone else was in the room.

The affidavit states the woman told police she later woke up to the man on top of her, kissing her and sexually assaulting her.

According to court documents, a staff member walked in, but the suspect hid and the woman did not say anything because she was too frightened.

After the staff member left, the woman said Tesfamariam raped her, according to court documents. A probable cause affidavit states the woman reported Tesfamariam returned a few hours later and raped her again.

The woman told police she struggled with the man and tried to get him off of her, court documents state.

The woman reported it to center staff who called police.

Detectives interviewed Tesfamariam who initially stated he shared a cigarette with the woman and she tried to kiss him, but he refused and denied ever having sexual contact with her, court documents state.

A probable cause affidavit states detectives confronted him about possible DNA, at which point Tesfamariam admitted going into her room while she was napping and when he saw her move over on the bed, he "presumed this was an invitation into her bed."

The man admitted having sexual intercourse with the woman, the affidavit states, and said she never said "no," but he did concede she may have tried to stop it.

He also admitted hiding in the room when center staff stopped by, but he gave different accounts of where he hid, according to court documents.

Tesfamariam is facing charges of first-degree rape and first-degree sex abuse. He was arraigned in court Wednesday and is being held on $1 million bail. Court documents state he is homeless.

The Multnomah County website describes the Crisis Assessment and Treatment Center as, "a 16-bed secure, locked facility in which people can stay from four to 14 days as their mental health symptoms stabilize."

On Thursday afternoon, the county issued a statement on the investigation.

“This is a law enforcement investigation and Multnomah County will not be commenting on this matter. What we can say is that the safety of clients who get treatment from the CATC is a priority.”
