SALEM, OR (KPTV) -

A Salem police sergeant who shot a suspect driving a stolen tow truck was justified in using deadly force, a Marion County grand jury has ruled.

Police located a stolen truck behind a pole barn on the 3600 block of Northeast Chemawa Road at 7:10 a.m. Jan. 1.

Investigators said the suspect, identified as 51-year-old Ronald Chilcote, drove the tow truck toward the officers. Sgt. Tony Moore fired two shots, hitting Chilcote in the shoulder once.

Chilcote drove away from the scene in the tow truck and led police on a chase, according to investigators. Police said Chilcote drove into a field and got stuck attempting to cross a drainage ditch.

He was taken into custody in the field behind a home on Lakeside Road Northeast.

Chilcote was taken to the hospital for treatment and then booked in the Marion County Jail.

On Monday, a grand jury found that Sgt. Moore was justified in shooting Chilcote, according to the Marion County district attorney's office. The grand jury also indicted Chilcote on charges of felon in possession of a firearm, unlawful use of a vehicle, felony elude, misdemeanor elude and recklessly endangering another person.

Chilcote is scheduled to be arraigned on the indictment Wednesday. He remained in jail Monday.

"Due to the ongoing nature of Ronald Chilcote's criminal cases, the DA's Office will not release any further details of the shooting or the crimes at this time," a Marion County district attorney's office release states.
