ALBANY, OR (KPTV) -

An Albany man was convicted of murdering his girlfriend and sentenced to life in prison with parole possible after 25 years.

A judge found Devin Hansen, 32, guilty of murder Monday and he was sentenced in court Tuesday.

Hansen was arrested in January 2014.

Police responded to an apartment on Southeast Geary Circle when Hansen called 911 to report he was performing CPR on 29-year-old Christine Smith.

According to court documents, Hansen said he had just returned from work and needed to rest before another 12-hour shift. He asked Smith, his girlfriend, to sleep on the couch so he could rest.

Hansen told detectives that she lashed out at him, threw things at him and scratched his face, according to a probable cause affidavit.

The affidavit states Hansen then admitted to holding her down on a couch, with his hand and forearm over her mouth.

"Devin told me he realized while he was holding her down that she was not breathing anymore," the officer on scene reported, according to court documents, later adding that Hansen said he regretted what had happened.

Hansen said he attempted to perform CPR and called 911. Smith was pronounced dead at the hospital.

Smith's 3-year-old daughter was in the home at the time of the altercation, a probable cause affidavit states.
