Lavoy Finicum’s wife reacts to his killing being found justified

The wife of Lavoy Finicum is speaking out after investigators announced Tuesday the use of deadly force used against her husband has been ruled justified.

One of the occupiers of the Malheur National Wildlife Refuge near Burns, Finicum was shot and killed on January 26. 

Aerial video provided by the FBI shows Finicum was stopped on Highway 395 by Oregon State Police troopers, but drove off from the traffic stop and encountered a police barricade.  He drove into a snowbank, nearly hitting an FBI agent, then got out of his truck.  Investigators say he twice went for an inner pocket in his jacket where he was known to carry a gun, and on the third time, Oregon State Police troopers fired three shots, killing him.

Investigators said OSP troopers also fired three shots at Finicum’s truck when he breached the barricade, believing their lives were in danger.

“I have concluded that all six shots fired by Oregon State Police… the three into the truck and the three that struck Mr. Finicum are justified,” Malheur County District Attorney Dan Norris told reporters.”

However, Lavoy Finicum’s widow disagrees.

Jeanette Finicum held a news conference of her own in Utah Tuesday, to respond to the investigative report.

She said police “continue to bring forward selective evidence.”

In a statement, she said in part:

“As in all such situations there is another side to this story.  … Our family asserts that he was shot with both hands up, he was not reaching for anything at the time of the first shot. He was walking with his hands in the air, a symbol of surrender. …I can hardly believe that a team of qualified law officers could look at the facts in this case and say that no criminal laws were violated.”

She said she is now seeking legal action, and has spoken with an independent investigator.  She plans to release more Wednesday.
