Driver who smoked marijuana before hitting, killing pedestrian sentenced to prison

A man driving under the influence of marijuana who hit and killed a woman in a Gresham crosswalk was sentenced to three years and 10 months in prison.

Jacob Walters, 27, pleaded guilty Tuesday to charges of DUII and criminally negligent homicide.

Walters was arrested after the collision on Northeast 181st Avenue and Burnside Street at 8 a.m. Oct. 5, 2015.

Investigators said he was driving a 2008 Toyota Prius westbound on Burnside when he struck 46-year-old Elizabeth Kemble in a marked crosswalk.

Kemble suffered severe injuries and died at the hospital.

Witnesses told police they saw Walters smoking what appeared to be marijuana seconds before the crash and officers confirmed his use of marijuana. According to court documents, Walters told officers that he felt a "little high."

Witnesses gave conflicting reports about whether Walters was driving through a yellow or a red light.

Kemble's husband and mother spoke in court Tuesday, but Walters did not make a statement.  

Outside the courtroom, Kemble's mother said she was satisfied with the sentence, even though the pain is still overwhelming.  

"I feel terrible. I feel lost. Elizabeth was my best friend. We were a very beautiful, close family," she said.

Police said Kemble was a three-time kidney transplant recipient.

As part of his plea agreement, additional charges of second-degree manslaughter and reckless driver were dismissed for Walters. 

Along with prison time, Walters received three years post-prison supervision and his driver's license was revoked for five years.
