Family wants justice for three-year-old boy killed by mom's boyfriend

A 39-year-old man is in jail charged with the murder of his girlfriends three-year-old son. Now, the family wants justice for the little boy.

The family of three-year-old Jose Castillo-Cisneros said they want justice for the little boy who will be desperately missed.

"Devastated. My sister...she's so sad."

Fighting back tears, Brenda Cisneros describes her nephew, they call Pepe, who turned three last week. The little boy was autistic and was just learning how to talk.

"He was full of joy, always playing around, trouble maker. I'm going to miss him a lot."

Ricardo Gutierrez appeared in court Tuesday morning to face a first degree murder charge. He shares a one-month-old son with Pepe's mother and has two prior assault convictions.

Court documents detail a violent, extended assault on Pepe in the family's home on Southwest 6th Street in Battle Ground Monday night.

"[My sister] just heard Pepe cry. He was screaming and she went upstairs and she said he was hitting him, threw him into the wall...horrible."

Brenda's sister told her she witnessed part of the assault and fought with Gutierrez to try to save her son.

Court documents said he only stopped when Pepe appeared to stop breathing.

"[My sister] feels guilty because he's a really tall guy, she really couldn't do much. She hurt her arm, her leg, her neck."

Pepe’s grandfather, Fernando Cisneros said he knew Gutierrez didn’t like the boy.

“No one understands what happened with him,” Fernando said. “The guy was supposed to be nice.”

It was Pepe's nine-year-old sister who called 911 to report Gutierrez was hitting her brother. She told detectives Gutierrez got mad because Pepe was crying and said the man hated her brother.

Court documents said Pepe had what looked like a knife wound on his head, along with several bruises on his face and head. 

"We want to make justice for [Pepe]. That was not fair. He was a little angel."

The Cisneros family has created a GoFundMe account to pay for Pepe's funeral expenses.

According to court documents, Gutierrez told detectives he didn't remember assaulting Pepe and has blacked out in the past when he was very angry.

Gutierrez is being held on $1.5 million bond.

“Right now it’s just trying to pass this day, but it’s really hard,” Fernando said. “We know it will be hard for us to keep going, but we will try.”
