Woman guilty of shooting, killing husband sentenced to probation

A woman initially accused of murdering her husband pleaded guilty to a lesser charge and was sentenced to probation.

Carolyn Rae Dimatteo pleaded guilty Wednesday to criminally negligent homicide with a firearm. She was then sentenced to five years supervised probation.

Dimatteo called 911 late the night of Dec. 26, 2015 and said she shot her husband.

Joseph Dimatteo, 69, was found dead in a fifth-wheel trailer on the 11500 block of Kingdom Lane Southeast in Stayton with a gunshot wound to his chest.

Court documents state Carolyn Dimatteo told investigators they had been drinking Fireball Cinnamon Whiskey and peach brandy when her husband threatened to kill her.

Carolyn Dimatteo said her husband advanced for a gun, but she got it first. A probable cause affidavit states she told investigators that she didn't intend to kill her husband, but detectives said she shot him even though she had a clear and unobstructed path to exit the trailer when she obtained possession of the gun.

Investigators said her account of what happened was "not consistent with findings at the scene," according to court documents.

Carolyn Dimatteo was initially booked into the Marion County Jail on the charge of murder, however a Marion County grand jury later indicted her for criminally negligent homicide.

The Marion County district attorney's office said she has no previous criminal history.

At sentencing, Marion County Circuit Court Judge Dale Penn said Carolyn Dimatteo's long, documented history as a victim of domestic violence was one of the factors that swayed him to grant her probation instead of prison time.

As part of her sentencing, Carolyn Dimatteo must meet a number of conditions including mental health counseling, drug and alcohol counseling, community service and restitution.
