Man sentenced to probation for public indecency in SE Portland Halloween store

A man who exposed himself in a Halloween costume shop in southeast Portland was sentenced to probation. 

Nigel Smith pleaded guilty May 27 to the charge of public indecency and was sentenced in court Monday. 

Police responded to the Spirit Halloween store on the 10500 block of Southeast Stark Street on reports of a fight on Oct. 27, 2015.

Officers arrived to find three men holding down another man on the sidewalk in front of the store.

An officer noted a "very noticeable wet spot" on the front of the suspect's sweat shorts, according to a probable cause affidavit.

The affidavit states Smith claimed it was sweat.

A witness told officers Smith was in the store masturbating while looking at photos of women on the packaging of Halloween costumes, according to court documents.

An employee chased after Smith and tackled him, court documents state, but Smith bit the worker.

Smith was initially charged with public indecency and fourth-degree assault, but the assault charge was later dismissed.

Smith was sentenced Monday to five years probation and he must register as a sex offender. He also must also undergo any required sex offender treatment.
