Local man plans to sue paving contractor for damage done to car

An Oregon City man says a road paving project caused serious damage to his car, but the contractor won’t pay for the damage.

On April 19th, Scott Morcom was coming to work near Sunnybrook Boulevard and 82nd Avenue in Clackamas, when he hit a ledge in the pavement and popped his tires. The road was being repaved at the time by Kerr Contractors, hired by ODOT.

Workers had just milled two inches of pavement in that area in preparation for repaving and the milling seems to have uncovered a pothole near the ledge.

A manager with Kerr Contractors told FOX 12 they put up a sign warning about a bump in the road. He said they did everything right according to their contract and project standards, and drivers just need to slow down in construction zones.

That’s why Morcom’s insurance claim was denied by the contractor’s insurance company, but he feels that’s not right.

“Dozens of people - including my coworkers - had to spend a half a day to get their cars fixed, money out of their pocket, loss of work all from a contractor who didn’t do his job properly that we pay taxes for,” said Morcom. “It’s very frustrating and I’m worried that other people are having the same experience that I’ve had.”

ODOT officials told FOX 12 in April that nine or ten drivers also reported similar damage to their cars sustained in the same area.

Morcom is planning to file a lawsuit against the contractor.
