Non-binary person wants gender designation recognized by Oregon DMV

It's a term you're probably hearing more often these days: non-binary. It means that a person does not identify as male or female.

One person in Portland just had that designation recognized in court, but getting the same from the Department of Motor Vehicles could be much harder.

Just like people who are transgender, non-binary people want their gender designation to be reflected on their driver's license. But one local person is worried it could take a long time before that happens.

Jamie Shupe identifies as non-binary. Shupe describes it like someone who is mixed race – a non-binary person is mixed sex.

On June 10, a judge signed a court order officially recognizing Shupe as non-binary in the legal system. But Shupe said they have been told by the DMV that getting that same recognition on their license could take months or more than a year.

A spokesman for the Oregon DMV tells Fox 12 that this is a brand new issue. It could take a while for them to look into it because their records and computer systems are not equipped to identify someone as non-binary.

He added that if this requires a statutory change, Shupe may have to wait until the next legislative session. But Shupe hopes that is not the case.

"I'm sympathetic that maybe they need a little time to work on this," Shupe told Fox 12. "I mean, it is like turning an aircraft carrier around. So I'll work with them, but if they start talking about years, my lawyer may take action against them."

The DMV spokesman said they are also looking at other states for solutions or guidance, but this DMV designation does not exist in any other state yet.
