Affidavit: Man sexually abused woman in Waldport apartment, ate food, refused to leave

A man entered a woman's apartment without permission, took away her phone, ate her food and then sexually abused her before taking a shower and sleeping in her room, according to court documents.

Deputies responded to a report of a burglary and sexual assault at a Waldport apartment complex at 8:30 a.m. Wednesday.

The woman told investigators a man entered her home at around midnight and she told him to leave or else she'd call police. A probably cause affidavit states the man then took away her cell phone and ate her food.

The affidavit states he then sexually assaulted the woman. According to court documents, a physical disability prevented the woman from stopping him or calling for help.

Court documents state after the assault, the man took a shower and slept in her room. He finally left at 7 a.m. the following morning.

The woman was interviewed by a deputy at the hospital, according to court documents.

Deputies contacted neighbors who learned a man with a similar description as the suspect had been at the apartment complex seeking food.

According to court documents, Richard Nygaard, 38, was found at a Newport motel Wednesday night. Deputies said he looked like a person caught by surveillance cameras at the crime scene.

Court documents state Nygaard told a deputy he couldn't recall much about the previous night, before admitting he entered the woman's apartment because he was "drunk and hungry."

"Nygaard said he didn't recall how the woman's cell phone got into his hand, but suddenly it was there. Nygaard said he put the woman's cell phone in the kitchen. He said he ate some food," a probable cause affidavit states.

Nygaard told investigators the woman was sending him "signals" and he believed he had "permission" to do sexual things to her, according to the probable cause affidavit.

Nygaard was arrested on multiple charges including first-degree burglary, first-degree sex abuse, first-degree attempted rape and interfering with making a report. His bail was set at $622,500.

Deputies said Nygaard is previously from Tuscon, Arizona.
