Woman charged with killing daughter at Oregon coast hotel appears in court

The Vancouver mother charged with killing her infant daughter and injuring her older daughter in Cannon Beach appeared in court on Wednesday. Lawyers are now arguing over whether or not police had the right to enter her hotel room.

It has been almost two years since police found a horrific scene inside Jessica Smith's hotel room at the Surf-Sand Resort.

Cannon Beach Police Chief Jason Schermerhorn was the first officer on scene after hotel staff called for help.

Once inside, Schermerhorn said he found two-year-old Isabella Smith dead and 13-year-old Alana Smith with wounds on her neck and wrists.

Jessica Smith disappeared but was found a few days later in the woods off of a logging road.

In court, Jessica Smith sat quietly as her lawyer argued that Chief Schermerhorn needed a warrant to enter the hotel room, but Schermerhorn said there was no time for that.

"[Alana] had lost a lot of blood and she was obviously in shock. And with the lacerations to her neck, and later I found as I was working on her, she had lacerations to her wrists as well. She needed immediate medical assistance."

Last month, the Judge ruled that Jessica Smith is mentally competent to stand trial.

After being put off a few times, no new trial date has been set yet.
