Police receive warrant to test blood of ex-Gov. Kitzhaber's son after Hwy 101 crash

LINCOLN CITY, OR (KPTV) -

The 18-year-old son of former Oregon Gov. John Kitzhaber admitted to drinking a beer prior to the crash that injured himself and two other people on Highway 101 on the Oregon Coast, according to court documents.

A search warrant affidavit states an investigating trooper had probable cause to believe there was evidence of crimes including DUII and reckless driving in connection with the crash near Devils Lake Road at 1:30 p.m. Monday.

No criminal charges have been filed at this time.

An Oregon State Police spokesman said a judge signed a warrant to order a blood draw on Logan Kitzhaber, which does not happen after every crash.

The search warrant approved the seizure by police of blood and urine samples from Logan Kitzhaber that were stored at OHSU.

The affidavit states Logan Kitzhaber told paramedics he did not know the reason for the crash. He also told paramedics, according to the affidavit, that he is a recreational marijuana user and had smoked marijuana the night before the crash

A witness told investigators Logan Kitzhaber suddenly pulled his 2008 Toyota Prius across the centerline to pass the vehicle in front of him and sideswiped an oncoming motorhome, according to court documents.

The Prius is registered to John Kitzhaber, according to police.

The car sustained severe damage and the motorhome ended up on its side.

Court documents state the 67-year-old driver of the RV required surgery for multiple broken and fractured bones. A 63-year-old woman in the motorhome sustained minor injuries.

Logan Kitzhaber was trapped in his car and had to be rescued by firefighters. He was flown to Oregon Health & Science University with injuries initially described by troopers as life-threatening, but he was later treated and released from the hospital.

John Kitzhaber released a statement Tuesday about his son saying, "He's doing well and recovering at home. Both Sharon (his mother) and I appreciate the outpouring of support."

Highway 101 was closed for one hour after the crash. One lane was then reopened with intermittent closures for another hour.
