Portland Public Schools settles sexual misconduct lawsuit

Portland Public Schools has settled a sexual misconduct lawsuit and promises to better handle harassment complaints in the future.

The lawsuit stemmed from a harassment case involving a longtime coach in the district. The employee who filed the lawsuit said complaints about the coach had been ignored for years.

The plaintiff worked at the Faubion School in northeast Portland, alongside physician education teacher and coach Mitchell Whitehurst.

The lawsuit claims that Whitehurst fondled the employee at work in front of his colleagues and according to the lawsuit, when the plaintiff complained to Principal LaShawn Lee, she told him Whitehurst should've been gone long ago after several previous allegations.

The plaintiff sued for $650,000, but the settlement gives him $250,000.

Along with the money, school board members are committing to a better response to complaints in the future involving sexual harassment and misconduct.

Last year, Whitehurst was allowed to retire and he did plead guilty to misdemeanor harassment related to the incident involving the man who filed suit.

Whitehurst was sentenced to 18 months probation.
