Man charged with assault, intimidation for incident at Iraqi restaurant in Portland

PORTLAND, OR (KPTV) -

A man accused of hitting a worker with a chair at an Iraqi restaurant in northeast Portland has been charged with second-degree assault and second-degree intimidation.

Damien Rodriguez, 40, was indicted Monday and arraigned on the charges Thursday. He is also facing the charge of disorderly conduct.

Rodriguez was initially arrested in April.

Officers responded to reports of a disturbance at DarSalam on Northeast 30th and Alberta Street. The restaurant’s owners said two men who appeared to be intoxicated walked into the restaurant and sat down for nearly an hour without ordering food.

Surveillance video showed one of the men pick up a chair and hit an Arabic employee with it after an argument.

Other workers held down Rodriguez until police arrived at the scene.

The employee was not badly injured.

Court records show Rodriguez is from Lake Elsinore, California and is an active duty sergeant major in the military with family in the Portland area.

Court documents state Rodriguez takes medication for PTSD.

Rodriguez was initially facing misdemeanor charges of harassment and disorderly conduct, but those charges were dismissed as prosecutors pursued felony charges.

A hate crime detective was assigned to the case, leading to the new indictment.

Rodriguez pleaded not guilty Thursday and remains out of custody.
