Salem security guard questioned after weekend shooting arrested, charged with murder

SALEM, OR (KPTV) -

Following an investigation into a shooting in a Salem parking lot early last Saturday morning, police arrested a security guard questioned at the scene Friday.

Detectives arrested 33-year-old Gregory Weston Capwell and transported him to the Marion County Corrections Facility. He faces a charge of murder.

Officers responded to the scene in the 3100 block of Ryan Drive Southeast around 3:26 a.m. Saturday after receiving reports of the shooting.

When they arrived, officers said they found 25-year old Jose Francisco Moreno shot and pronounced him dead at the scene.

Investigators interviewed Capwell, who is employed by Homefront Security, at the scene of the shooting. Since that time, police said they’ve conducted extensive interviews and reviewed video surveillance before making the arrest Friday.

Police haven’t said what exactly happened Saturday, but Keith Babcock, a good friend of Moreno, told FOX 12 he had an idea about what initiated the incident.

“Jose, he had to, he had to pee, so he was peeing in the parking lot,” Babcock said. “We grew up in the hills, I mean it's not a big deal where we come from, and the security guard came up and start harassing him.”

Babcock said two other friends with Moreno that night said they all left the scene and went to get some food. He said the friends told him Capwell had followed them and began harassing them again after they left a restaurant.

From there, Babcock claimed the situation escalated quickly. He Capwell tried to arrest Moreno, who instead walked away until Capwell shocked him with a stun gun.

Babcock said the other friends tried warning Capwell that Moreno had a medical condition.

"After the Taser was fired the first time, they alerted the security guard that he had a pacemaker,” he said. “He proceeded to tase him again.”

Babcock claims one of Moreno’s friends then started to walk towards the security guard, which Babcock said escalated the situation even further.

“From what I was told, that's when the security guard pulled his gun and shot Jose,” he said.

Babcock said Moreno’s death is a tragedy that should have never happened.

"I can't put into words really what an amazing person he was,” he said. "All I know is that Jose is a good person and he didn't deserve this. Of all the people, Jose would literally give you the shirt off his back."

FOX 12 reached out to Homefront Security and did not hear back from the company. The company’s website was also down as of Friday night.

Capwell is scheduled to appear in court Monday afternoon.
