Department of Justice investigating Portland Marathon’s nonprofit status

The Oregon Department of Justice is investigating the Portland Marathon’s status as a nonprofit organization.

The DOJ confirmed Tuesday that its Charitable Activities Division is conducting the investigation and it is not criminal in nature.

A DOJ spokesperson said the Portland Marathon’s tax forms have two names on them, however three are required to claim nonprofit status.

Citing the open investigation, no further details were released.

The news comes as the Portland Marathon is still without a permit to host a race in 2017.

A permit for the Portland Marathon was denied in June. City officials said the route needed to change, citing police staffing issues, and a letter was sent to race organizers about it last October. Race organizers initially refused, saying the route had been the same for 25 years.

In July, organizers agreed to a new route.

A Portland Bureau of Transportation spokesman said while they are interested in the outcome of the DOJ investigation, they are currently working with marathon organizers to put on a safe event.

As of July 31, city workers said marathon organizers had met nearly all of the conditions set for them, including pre-paying the estimated cost of Portland Police Bureau and PBOT services, agreeing to a new route and working toward approving a final medical plan with Portland Fire & Rescue.

PBOT said some details of the new route still need to be worked out, but a spokesman said as long as the spirit of communication and cooperation continues, it is believed the Portland Marathon will qualify for a permit.

The race has been scheduled for Oct. 8.
