Battle Ground police said Tuesday morning that the boy died from his injuries.

Ricardo Gutierrez, a man who lived at the home and was in a relationship with the boy's mother, is charged with one count of first-degree murder.

Neighbors in the area watched the entire scene unfold, and said it was difficult to see a child hurt.

"It's a very sad situation," said neighbor Paul Harrison. "There's so many kids in this neighborhood and we take turns watching everyone's kids. It's like one of our own, it's heartbreaking."

The Clark County Sheriff's Major Crimes Unit was still on scene Tuesday investigating.
