Family files $10M wrongful death lawsuit after Fairview plane crash
FAIRVIEW, Ore. (KPTV) - The partner of a woman who was killed when a small plane crashed into their townhome last August is now suing for $10 million in a wrongful death case.
The crash happened on Aug. 31, 2024. According to the NTSB, the twin-engine Cessna took off from the runway at the Troutdale Airport at 10:15 a.m. and crashed only 15 minutes later into a row of townhomes on Heartwood Circle.
Three people were killed in the crash and were identified as 75-year-old Barbara J. MacDonald, of Fairview (Resident); 73-year-old Michael C. Busher, of Beavercreek (Pilot); and 79-year-old Jacqueline K. Whitford, of Glendale, Arizona (Flight Instructor).
MacDonald lived in the townhome with her partner, Kent Walton. Walton has now filed a $10 million wrongful death lawsuit.
According to the suit, the company responsible for inspecting and maintaining the aircraft - Emerald Aircrafter - was negligent, allowing the plane to fly that day in unsafe condition.
The lawsuit also points to the two pilots who died in the crash, accusing them of failing to check if the plane was airworthy and not choosing a safe spot to attempt an emergency landing.
Finally, the complaint claims the plane’s owner, Circle Capital, failed to properly maintain the aircraft.
FOX 12 reached out to Emerald Aircrafter for a comment on the lawsuit and have not yet heard back.
